Terms of Service for Jewelry Sales Academy LLC
Introduction
1.1 Contract

This Contract applies to both Members and Visitors. When you register and join Jewelry Sales Academy, you become a “Member.” If you have not registered for our Services, you may access certain features as a “Visitor.”

We may modify this Contract, our Privacy Policy, and our Cookie Policy from time to time. If we make material changes, we will notify you through our Services or other means, providing you an opportunity to review the changes before they become effective. Jewelry Sales Academy offers aptitude tests, CRM tools, sales analytics, and skill-based courses to aid in hiring, sales, and operational processes. These resources are voluntary and provided “as is.” We make no guarantees regarding the accuracy, reliability, or suitability of these tools. Employers, businesses, and candidates agree that we are not liable for hiring or sales decisions made based on test results, CRM insights, or course completions.
2.4 Notices and Messages
You agree that we may send notices and messages to you within the Services or via the contact information you provide (e.g., email, phone). Ensure your contact information is current to avoid missing important communications.
2.5 Sharing
When you share content on our Services, others can see and use that information. You are responsible for ensuring that your shared content complies with applicable laws and does not infringe the rights of others.
3. Rights and Limits
3.1 Your License to Jewelry Sales Academy

3.4 Indemnification
Users agree to indemnify and hold harmless Jewelry Sales Academy LLC, its affiliates, and employees from any claims, liabilities, damages, or expenses arising out of their use of the platform or violation of these terms.
3.5 Arbitration Clause
Any disputes arising from this agreement shall be resolved through binding arbitration under the rules of the American Arbitration Association in Pulaski County, Arkansas.
3.6 Limitations on Claims
Any claim or cause of action arising out of or related to the use of our Services must be filed within one (1) year after such claim or cause of action arose or be forever barred.
3.7 Third-Party Disclaimer

We do not verify the credentials of job applicants, sales staff, or employers and are not responsible for hiring or sales outcomes. Users acknowledge the inherent risks in these processes and rely on provided information at their own discretion.
3.11 Data Security Liability Disclaimer
We are not liable for damages arising from unauthorized access to data unless due to gross negligence. Users acknowledge that no system is entirely secure and assume risks associated with using the Services.
3.12 Limit on Direct Damages
Our total liability for direct damages shall not exceed the fees paid by the user in the 12 months preceding the claim.
3.13 Content and Language Disclaimer
We are not responsible for any language, wording, or video content provided through our Services. Users agree that all such materials are for informational purposes only and that they rely on this content at their own discretion and risk.
4. Disclaimer and Limit of Liability
4.1 No Warranty

We do not participate in hiring, staffing, or sales decisions made by businesses or individuals using our platform. All hiring, termination, employment, and sales decisions are the sole responsibility of the business or individual. We disclaim liability for any claims or disputes arising from such decisions.
4.5 Disclaimer of Content Accuracy
We do not guarantee the accuracy, completeness, or reliability of any content, courses, skills tests, CRM tools, or analytics provided through our Services. Businesses and users agree that they rely on such resources at their own risk. We are not responsible for any decisions made based on this content.
4.6 Liability for User-Provided Information
We moderate posts, reviews, and content shared on the platform but cannot guarantee the accuracy or truthfulness of user-provided information. Users agree not to hold us liable for any false or misrepresented information shared by other users. Reliance on user-provided information is at your own risk.
5. Termination
Both you and we may terminate this Contract at any time. Upon termination, you lose the right to access or use the Services. Certain provisions, including our rights to your feedback and Sections 4 and 6, will survive termination.
6. Governing Law and Dispute Resolution
This Contract is governed by the laws of the State of Arkansas, U.S.A., without regard to conflict of laws principles. All disputes shall be resolved in courts located in Pulaski County, Arkansas, unless otherwise required by law.
7. General Terms
If any part of this Contract is unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision does not constitute a waiver. This Contract supersedes all prior agreements and represents the entire agreement between you and us.
